Carr sues former partners for attorneys' fees

Rex Carr filed a civil suit seeking a declaratory judgment against Korein Tillery in Madison County Circuit Court March 21, alleging the firm has received attorney fees that were due to him.

According to the suit, prior to March 10, 2003, Rex Carr, Stephen Tillery, Steven Katz and Douglas Sprong were members of Carr Korein Tillery and that firm dissolved and the cases and clients of the firm were distributed to its members.

Carr claims that on April 15, 2003, Tillery, Katz, and Sprong formed Korein Tillery LLC and agreed to receive and distribute fees generated from the cases to the former members of the old firm.

Carr claims Korein Tillery collected fees from eight cases which caused the parties to enter into an agreement called "Memorandum of Understanding" on April 21, 2004.

"Korein Tillery has received all the monies from the cases and will receive future monies from future cases and a dispute had arisen between Carr and Korein Tillery as to the share of such fees to be allocated to Carr," the complaint states.

Carr asks the court to resolve the disputes in accordance with the Memorandum of Understanding and the documents refered to in the memo.

The case was filed in the court's miscellaneous remedies docket, but claims to have a value in excess of $50,000.
