A St. Louis personal injury firm filed two Federal Employers' Liability Act lawsuits in St. Clair County on behalf of locomotive engineers who reside outside the Metro-East.
Attorney Dawn M. Mefford of Simon Passante, P.C., filed the complaints Feb. 28.
Plaintiff James Geisler of Schuyler County, Ill., located in the west central part of the state, claims his left knee twisted when the ground beneath his foot gave way as he was walking from his engine to a Kansas City Southern Railway parking lot on Aug. 31, 2006.
He claims the railroad failed to provide him with a reasonably safe walkway from his locomotive to the parking lot.
Geisler claims he was required to undergo surgery for a tear of the medial meniscus and developed a post-operative infection. The suit also claims he underwent arthroscopic debridement and developed septic arthritis and was caused to ingest antibiotics.
Plaintiff Nathaniel Grant of St. Louis claims his right knee was severely injured in Alton & Southern Railway Co.'s East St. Louis rail yard when a grab iron on which he was standing broke off the car on which he was riding, causing him to fall on Dec. 4, 2005.
He claims the railroad failed to provide him with a reasonably safe place to work and failed to maintain its equipment in proper working condition.
His suit, which also asks for damages under the Safety Appliance and Equipment Act, seeks in excess $100,000 in damages for pain and suffering, lost wages, medical expenses and permanent partial disability.
