St. Clair County is suing a motorist for rear-ending a county highway foreman who was injured on March 2, 2005.
Seeking in excess of $11,600.57 in damages paid on a workers' compensation claim, the county alleges it has a statutory subrogation right to file suit against Holly Schaefer of Millstadt.
According to the lawsuit filed Feb. 28 in St. Clair County Circuit Court, Schaefer failed to stop as required, striking a vehicle driven by county highway foreman Kerry G. Davis at the intersection of Washington and Jefferson Streets in Millstadt. Davis was stopped at a stop sign, the suit states.
Davis suffered headaches, and shoulder, neck and back injuries, the suit claims.
The county is represented by Van-Lear P. Eckert of Becker, Paulson, Hoerner & Thompson of Belleville.
