Allsup suit claims 'unlawful' termination

Karen Domyan filed suit against her former employer Allsup Inc. claiming she was fired after filing a workers' compensation claim.

Represented by Rhonda D. Fiss of Belleville, Domyan is seeking in excess of $200,000 in compensatory damages and more than $300,000 in punitive damages.

According to the suit filed Feb. 9 in St. Clair County Circuit Court, Domyan filed a claim Feb. 17, 2005, for a work place injury that happened on Jan. 7, 2005.

The suit claims Allsup paid Domyan's medical and temporary total disability benefits pursuant to her claim.

She was "unlawfully" terminated Feb. 21, 2005, "because plaintiff was exercising her rights under the Workers' Compensation Act," the complaint states.

Domyan claims she lost income and benefits and has and will experience emotional distress and loss of reputation and marketability.

Co-defendants include James F. Allsup, Jeanne Allsup and Brian D. Spurgeon.
