Wrongful death suit filed against farmer

Ag Chem Terra Gator

A Monroe County woman whose husband was killed on State Route 15 while riding a motorcycle four months ago, is suing the owner and operator of a vehicle used to spray farm fields.

Betty Dossett claims Rodney Kehrer of Marissa, operating a 1990 Ag Chem Terra Gator, pulled into the path of James Dossett who was traveling east on Route 15 near Owl Road on Oct. 2, 2006.

Dossett is seeking in excess of $50,000 in damages from Kehrer and Terayne Ag Specialties, according to a suit filed Jan. 26 in St. Clair County Circuit Court.

"The aforementioned collision occurred as a direct and proximate result of the negligence, carelessness, recklessness and fault of Terayne by and through its employee," the complaint states.

Dossett claims Kehrer failed to yield, failed to keep a proper lookout, failed to obey traffic laws and failed to give a proper warning to oncoming traffic that the Gator was proceeding to pull onto the highway where oncoming traffic was traveling.

She is represented by Russell F. Watters of Brown and James in St. Louis.
