Woman blames convenience store for assault

Janet Moffitt filed a Dram Shop suit against Meehan's BI-Rite Market and Kevin Todd Kinser, claiming Kinser assaulted her after drinking alcohol he purchased from the Bunker Hill convenience store.

Moffitt claims she was a passenger in Kinser's vehicle when he assaulted and battered her while under the influence of alcohol. The incident took place on July 23, 2006, in Roodhouse, which is in Greene County.

According to the suit filed Jan. 26 in Madison County Circuit Court, Moffitt claims the store gave or sold intoxicating liquors to Kinser which he drank and became intoxicated.

Moffitt claims the assault caused injuries to her head, back, and neck which caused her to experience pain and suffering, disability, medical expenses, loss of wages and a diminution of her earning capacity.

Represented by Lance Mallon of Wood River, Moffitt is seeking damages in excess of $50,000, plus costs of the suit.

The case has been assigned to Circuit Judge David Hylla.
