Garden Ridge floor mat trips customer, suit claims

A Moro woman filed a personal injury suit against Garden Ridge in Madison County Circuit Court Jan. 23, claiming she was injured after tripping on a floor mat in the foyer on Jan. 29, 2005.

Patricia Franklin claims Garden Ridge carelessly and negligently left a floor mat curled up in the foyer of its O'Fallon premises for an unreasonably long period of time creating a condition the store knew was hazardous.

She also claims they failed to inspect the foyer, failed to warn patrons the foyer was unsafe, failed to remedy the unsafe condition, failed to maintain the foyer and floor mat and failed to properly affix the door mat to the floor.

Franklin further claims that Garden Ridge allowed the floor mat to become and remain worn, frayed and curled for a long period of time and negligently failed to properly and adequately light the foyer so that patrons would be able to see the floor mat.

According to Franklin, she sustained injuries of a permanent and lasting nature that caused and will continue to cause pain in the body of mind, medical expenses, loss of wages and the prevention from attending to her usual affairs and duties.

Represented by James Stever of The Law Offices of Michael Bilbrey in Edwardsville, Franklin is seeking damages in excess of $50,000.

The case has been assigned to Circuit Judge Barbara Crowder.
