William Baker filed a personal injury suit against the Bethalto McDonald's in Madison County Circuit Court Jan. 23, claiming he was injured on June 9, 2005.
Baker claims that after walking to the food counter to retrieve some cookies he was walking back to his seat when he tripped over a chair that had been left in the aisle way.
According to Baker, McDonald's was negligent by placing a chair in the aisle where patrons are known to walk, failed to warn patrons that a chair was placed in the aisle and failed to return the chair to its proper location.
He claims his injuries caused him to suffer pain of the body and mind, incur medical expenses and to lose sums of money he otherwise would have earned.
Represented by Samuel Mormino, Jr. of Alton, Baker is seeking damages in excess of $50,000.
The case has been assigned to Circuit Judge Daniel Stack
