Father claims Alton school failed to protect daughter from attack

An Alton man claims the dean of students at Alton Community Unit School District 11 ignored his warning of physical threats being made against his daughter.

Representing himself, Trezel Brown filed suit against District 11 in Madison County Circuit Court Jan. 18, claiming the school failed to act to protect his daughter even though he advised the dean of physical threats of imminent bodily harm made by two senior students against his daughter.

Brown claims he notified the dean of problems on Sept. 13, 2004.

The next day at school, despite his prior warning, his daughter was attacked and injured, the suit claims.

Brown alleges the school was negligent by failing to properly supervise its students, failing to employ safety measures to protect his daughter after knowledge of impending danger and failing to restrain the attackers after receiving actual or constructive notice of a high probability of serious harm.

Brown also claims the school failed to exercise ordinary care to prevent harm and failed to discover the high probability of serious harm to his daughter when it could have been discovered.

He claims his daughter sustained permanent injuries, pain and suffering, physical, emotional and neural trauma.

Brown claims he also is liable for past and future medical expenses. He is seeking damages in excess of $150,000.

The case has been assigned to Circuit Judge David Hylla.
