Ray and Dorothy Higgins filed a dram shop suit against PJ's Lounge claiming the Highland tavern sold alcoholic beverages to a man who became intoxicated and later crashed into Ray Higgins.
According to the suit filed in Madison County Circuit Court on Jan. 5, PJ's served Scott Hampton too much alcohol on Jan. 9, 2006, and after becoming intoxicated collided into Higgins on Route 160, 800 feet west of North Ridge Drive.
He claims PJ's breached the Illinois Dram Shop Act, and as a result sustained severe and permanent injuries and also past and future pain and suffering and loss of past earnings.
Dorothy Higgins claims that under the Illinois Family Expense Act, she became liable for all expenses incurred as a result of the medical treatment Ray received.
She also claims that she has suffered a loss of means and support as a result of Ray's injuries.
Represented by James Gorman of Edwardsville, the Higgins' are seeking damages in excess of $50,000, plus costs.
The case has been assigned to Circuit Judge Dan Stack.
