Barroom beating victim seeks $600k

Patty's Pub in Fairmont City

A Fairmont City man filed suit against Patty's Pub II, Patricia Alvarez and Richard Skinner in Madison County Circuit Court Jan. 5, claiming he sustained injuries after being assaulted at the Fairmont tavern.

Craig Garcia claims that on Jan. 8, 2006, he sustained severe and permanent injuries when Richard Skinner, without provocation, attacked and assaulted him.

Represented by Pat Johnson and Ben Stephens of Edwardsville, Garcia is seeking damages in excess of $600,000.

He claims Skinner was intoxicated at the time of the alleged attack and that the tavern supplied the alcohol.

Garcia claims the tavern failed to properly install adequate security, failed to warn of dangerous activities of the parties at the establishment, failed to ban Skinner from the premises, failed to intervene on his behalf after the attack started and failed to train employees on how to avoid or stop a physical attack.

He also claims Patty's failed to properly notify the authorities in a timely manner to protect him from criminal attack and failed to protect him from a physical attack at its establishment.

Garcia claims his injuries have caused him to suffer great pain and anguish. He also claims medical expenses, lost wages and that he has been damaged in his future earning capacity.

The case has been assigned to Circuit Judge Nicholas Byron.
