A messy mixture of beer and mixed drinks caused patrons of Pop's Saloon in Sauget to collide on the dance floor.
Stanley Pyszka of Mt. Vernon filed a personal injury suit against Mega Leasing Corp., Inc., doing business as Pop's, in St. Clair County Circuit Court Dec. 29.
He claims that on Jan. 15, 2005, he was standing against the stage of Pop's dance floor when another patron, Jason Vanmeter, slipped on the wet floor and collided with him.
Pyszka claims he sustained severe and permanent injuries to numerous parts of his body and nervous system and their existing functions have been impaired.
The spilled drinks "presented an unreasonable risk of harm to persons on the dance floor," the complaint states.
Pyszka, represented by Nathan C. Lanter of Nelson & Nelson in Belleville, is seeking in excess of $50,000 in damages plus costs of the suit.
The suit claims Pyszka lost great sums of earnings and will incur further loss in the future; he has become responsible for hospital and medical expenses and will incur further liability in the future and he has suffered and will continue to suffer from great mental and physical pain.
Pyszka claims Pop's was negligent for carelessly permitting beer and/or mixed drinks to accumulate on the dance floor and to remain on the dance floor; failing to warn; failing to clean the dance floor, failing to maintain the premises in a condition free from defects and failing to place flags, cones or signs around the mess condition.
