Lisa Abernathy filed a retaliatory discharge suit against Rosewood Care Center in Madison County Circuit Court Dec. 18, seeking damages in excess of $50,000.
According to Abernathy, she was hired at Rosewood on May 6, 2005, and was discharged from her position on July 17, for her inability to work due to a work-related injury.
She claims she was discharged in retaliation for exercising her rights to received benefits under the Illinois Workers' Compensation Act.
Represented by Lance Mallon of Wood River, Abernathy claims she has lost wages, benefits, raises and promotions, costs associated with finding new employment, a diminution of wages and humiliation and stress.
The case has been assigned to Circuit Judge Nick Byron.
