Nancy Corrington filed a personal injury suit against Ace Hardware of Bethalto in Madison County Circuit Court Dec. 4, claiming the hardware store was negligent.
According to Corrington, she was a patron at the store on May 12, and tripped and fell over a downspout that had been placed in a narrow passageway where patrons commonly walk to enter the establishment.
She claims Ace failed in its duty to exercise reasonable care by placing the downspout in a narrow walkway, failed to warn of the downspout and failed to paint the downspout to warn the patrons.
Corrington claims she injured both arms, sustained pain and suffering, lost wages, became liable for medical expenses and suffered a disability.
Represented by Samuel A. Mormino of Alton, Corrington is seeking a judgment in excess of $50,000.
The case has been assigned to Circuit Judge Dan Stack.
