Tamera Phelps filed a personal injury suit against K-Mart in Madison County Circuit Court Nov. 27, claiming she was injured at a Granite City store on Sept. 24, 2005.
Phelps claims she slipped and fell on a liquid near a checkout lane due to K-Mart's failure to mop up the spill from a refrigeration unit.
According to Phelps, K-Mart failed to warn her and other customers that the water was on its floor and failed to timely mop up the spill near the soda unit.
Phelps claims the fall caused severe, extensive and permanent injuries to her knee and low back which resulted in disability and disfigurement.
She also claims the fall caused her to suffer great physical pain, mental anguish, loss of wages and the loss of a normal life.
Represented by Matthew Marlen of Belleville, Phelps is seeking damages in excess of $50,000, plus costs.
