Value City sued by customer who tripped

St. Clair County resident Cheryl Neville is suing Value City Department Store in Swansea for injuries sustained after tripping in the store.

Neville, who was returning a pair of shoes when the incident occurred Nov. 29, 2005, claims she injured her neck, spine, back, right shoulder, right arm, hands, legs, knees, feet, ankles and the remainder of her body both internally and externally.

She is seeing in excess of $250,000 in damages plus costs of the suit.

"...the plaintiff tripped and/or fell over a flatbed or platform or short table or some other item of merchandise or debris located on the floor of the premises," states the complaint filed Nov. 14 in St. Clair County Circuit Court.

Represented by Rhonda Fiss of Belleville, Neville claims the store is negligent for failing to protect her from the danger imposed by the item she tripped over, among other allegations.

"...plainfiff did endure and will in the future endure extreme physical and mental pain, suffering and anguish," the complaint states. Neville claims she incurred and will in the future incur expenses for hospital and medical treatment and claims lost wages.
