Driver in tragic crash sued in St. Clair County

A tragic automobile crash in May that claimed the life of one Belleville youth and severely injured another, is the subject of a lawsuit filed in St. Clair County Circuit Court Oct. 10.

Daniel Polites, the driver, is being sued by Barry Frazier, father of Timothy Frazier. Timothy Frazier was killed in the accident that occurred May 27 on Route 163 between Belleville and Millstadt. He died the next day.

Another passenger, Bradley Fairbairn, is suing Polites for severe injuries. His father, Matthew Fairbairn, is acting on his behalf in the lawsuit.

Represented by Thomas Q. Keefe and Randall Kelley of Belleville, the plaintiffs claim Polites, a minor at the time, drove too fast, was under the influence of alcohol and failed to keep his vehicle under control.

Polites was driving a 2004 Ford Mustang.

Frazier and Fairbairn are seeking in excess of $75,000 each in damages, plus costs.

In the suit, Frazier claims the family has been permanently deprived of Timothy Frazier's love, companionship, guidance, support and they have incurred medical and funeral expenses.

Fairbairn claims serious, painful and permanent injuries, including facial injuries.
