Therapy provider sues nursing home for withholding Medicare payments

Therapeak Inc., a provider of rehabilitation therapy services, is suing a nursing home owner for not paying $491,170.87 in Medicare reimbursements.

According to a suit filed Sept. 25 in St. Clair County Circuit Court, Bridgemark LLC, which does business as Cardinal Healthcare, Bridgemark of Greenville, Cardinal Hill Healthcare, Caremore Communities and Swansea Care Center, billed and received payment from Medicare for professional services provided by Therapeak.

Stephen P. Miller also is named as a defendant.

"Although demand for payment has often been made, Defendants have failed and refused and continued to fail and refuse to pay said amount or any part thereof," the complaint states.

Represented by Mitchell D. Jacobs of Clayton, Mo., Therapeak is seeking $491,170.87, plus interest and attorneys' fees.

"Monies acquired from Medicare should have been held in constructive trust for Therapeak, Inc. for payment of professional services rendered by Therapeak, Inc.," the complaint states.
