A Belleville doctor who retired last year because of escalating medical malpractice insurance is being sued by a former patient.
Kenneth D. Mitchell claims his hip was dislocated as a result of Dr. Donald I. Serot's negligence in a suit filed Sept. 8 in St. Clair County Circuit Court.
Serot, a board certified orthopedic surgeon, retired in July 2005.
Mitchell claims Serot placed an undersized femoral component in a hip replacement surgery performed at Memorial Hospital in Belleville on Oct. 12, 2004.
According to the suit, Serot also negligently positioned the femoral component during the same surgery. Mitchell also claims that Serot placed an ace tabulum in 20 degrees of retroversion instead of 30 degrees of antiversion during another procedure performed Feb. 22, 2005.
"The Plaintiff suffered dislocation and he suffered injury to his body as a whole," the complaint states.
Mitchell claims he has suffered severe and permanently disabling injuries and mental anguish and has incurred medical expenses.
An affidavit signed by Jeffrey Meisles, M.D., an Elmhurst, Ill. orthopedic surgeon, was attached to the complaint. It states, "In my opinion, there is a reasonable and meritorious cause for filing a medical malpractice action against his health care providers."
The Center for Orthopedics and Memorial Hospital also are named in the suit filed by Belleville attorney Joseph A. Bartholomew of Cook, Ysursa, Bartholomew, Brauer & Shevlin.
Mitchell's wife, Pearl, is seeking damages for loss of consortium.
