Defendant Carr settles car accident suit

Rex Carr will not have to answer questions on the witness stand in a car accident trial that was expected to begin Sept. 11.

Carr settled a lawsuit that accused him of rear-ending a vehicle as he was leaving the courthouse in Edwardsville on May 21, 2004.

Jason Shafer filed suit Nov. 3, 2005, in Madison County Circuit Court, claiming he was rear-ended by Carr's 2002 BMW on as he was stopped at the intersection of St. Louis and Vandalia Streets in Edwardsville.

Shafer was driving a 1994 Chevrolet. He was seeking at least $50,000 in damages. The terms of the settlement are confidential.

According to the Shafer, Carr was negligent for failing to keep a proper lookout, failing to reduce his speed to avoid a collision and traveling too fast for conditions.

Shafer claims he sustained injuries to his neck and right shoulder, incurred medical expenses for care and treatment and will incur additional medical expenses in the future, experienced pain and suffering and his quality of life has been diminished.

Shafer was represented by John Leskera of Collinsville. Carr was represented by G. Bradley Hantla of Litchfield.

Circuit Judge Don Weber signed off on the settlement. He dismissed the case with prejudice.
