A softball player filed a personal injury suit against the Granite City Park District because his left hand was cut on the outfield fence at Wilson Park while trying to catch a fly ball.
Alan Williams claims the park district had actual and constructive notice that the fence's safety guard was in disrepair, according to the lawsuit he filed Sept. 7 in Madison County Circuit Court.
The incident took place Sept. 22, 2005.
"Prior to September 22, 2005, said diamond at Wilson Park had been allowed to fall into disrepair including the protective covering over the top of the outfield fence," the complaint states.
Williams claims it was the duty of the park district to refrain from engaging in a willful and wanton course of action that showed an utter indifference to the welfare of the people using the softball field.
According to the complaint, Williams has been injured, damaged and incapacitated, has incurred and will continue to incur future legal obligations for hospital, medical, nursing, rehabilitative and related services and treatment, has lost and will lose profits, wages and earnings which he would have otherwise made and acquired and has suffered and will continue to suffer pain, disability, disfigurement, and inconvenience.
Williams is represented by Steven Dioneda of St. Louis.
The case has been assigned to Circuit Judge Don Weber.
