Man claims attack by Juicy Peanut workers

A case of mistaken identity was no laughing matter for Nathan Holtz who claims workers at the Juicy Peanut Bar & Grill in Mascoutah fractured his left humerus during a barroom scuffle last year.

Holtz claims he was attacked without provocation while a "business invitee" of the bar on May 7, 2005, according to a suit filed Aug. 17 in St. Clair County Circuit Court.

"Defendant negligently and carelessly confused the identity of the plaintiff with other patrons who may have been causing an interruption at the defendant's establishment," the complaint states.

Represented by Thomas G. Kemper of Arnold, Mo., Holtz is seeking in excess of $50,000 in damages.

Holtz claims he suffered serious injuries, incurred medical bills and lost income as a result of the defendant's negligence.

"Defendants negligently and carelessly failed to properly supervise their employees in allowing said attack to occur," the complaint states.
