Concrete ruined by negligent driver, suit claims

Keller Construction filed a civil suit against Wilma Chase of Collinsville alleging she damaged a road construction project by negligently driving on an 870-foot section of freshly poured concrete.

According to the complaint filed Aug. 4 in Madison County Circuit Court, Chase was driving near 6600 Governor's Parkway in Glen Carbon when her vehicle made contact with the uncured cement. The incident took place on Oct. 3, 2005.

Keller owned a contract for construction of that section of road.

"Wilma Chase owed a duty of reasonable care to Keller and its personal property," the complaint states.

Keller claims Chase failed to abide by traffic barriers, failed to heed warning signs blocking the road to traffic, and continued to drive over uncured cement after she was aware of the damage she was causing.

"Chase's negligence was the proximate cause of the damage to Keller's recently poured, uncured cement in the sum of $81,614.64," the complaint states.

In addition to the amount damaged, Keller is seeking pre-judgment interest at the statutory rate, attorney's fees, costs of the suit and any additional relief the court deems just.

Keller is represented by Christopher Byron of Byron, Gerber, Petri & Kalb of Edwardsville.

The case has been assigned to Circuit Judge Don Weber.
