Mom sues daughter's apartment complex owners for trip

A woman who tripped while leaving her daughter's apartment complex in Bethalto filed a personal injury suit against the owners of the apartments claiming they failed to exercise reasonable care for the safety of others.

Kathy Cox claims she tripped and fell over an unpainted barrier that had been placed on the parking lot located at 326 East Central on Nov. 30, 2005.

According to the complaint filed Aug. 7 in Madison County Circuit Court, the apartment complex is owned by Austin and Margaret Opp.

Cox claims the Opps failed to paint the barrier to warn visitors it had been placed, failed to warn visitors of the dangers posed by the concrete barrier and negligently placed a concrete barrier in an area where they knew visitors of the apartment complex would walk.

Cox alleges she sustained injuries to her right arm, hand, wrist, and right knee that caused pain of body and mind.

Represented by Samuel Mormino, Jr. of Alton, Cox is seeking damages in excess of $50,000, plus all costs of the suit.
