Laundry bags responsible for woman's injuries, suit claims

Delta Queen

A woman injured while climbing over laundry bags filed a Jones Act suit against Delta Queen Steamboat Company in U.S. District Court May 25, claiming her employer failed to provide her with a safe place to work.

Eleanor Downen claims she sustained injuries after falling over the laundry.

According to the complaint, Delta Queen failed in its duty to provide medical care and maintenance and cure resulting in an aggravation of her injury.

She does not name the date the injury allegedly occurred.

Downen claims her injuries caused pain and suffering, mortification, humiliation, fright, shock and embarrassment, loss of wages, mental anguish and medical expenses.

Represented by Dennis O'Bryan of Birmingham, Mich., Downen is seeking damages in excess of $75,000, plus costs and attorney fees.

The case has been assigned to District Judge G. Patrick Murphy.
