An Edwardsville woman claims Home Depot failed to maintain its store in a reasonable manner in a lawsuit filed May 19 in Madison County Circuit Court.
Riese Hall alleges she hurt her left knee, left elbow, and suffered a torn rotator cuff after tripping on a board she could not see while shopping at the Edwardsville store on May 24, 2005.
Hall, represented by Ted Gianaris of SimmonsCooper, is seeking compensatory damages in an amount to be proven at trial, but believed to exceed $50,000.
According to the complaint, Home Depot breached its duty to her by placing a restock cart at the end-cap of a stock aisle in such a way that a board extended from the restock cart across the aisle.
Hall was shopping for materials for a home addition.
She claims the board was placed in a way that she could not see it, nor expect to see it.
"The board acted as a trip line causing Hall to fall violently to the concrete floor," the complaint states.
Hall claims the incident required her to seek medical treatment and undergo surgery, physical therapy. Her suit claims lost wages and physical and mental pain.
