Driver suing International Truck in St. Clair County

Truck driver Warren Miles is suing International Truck and Engine Corp. and Hogan Motor Leasing for severe head injuries he sustained because his vehicle was not equipped with a seat belt.

Miles filed the suit in St. Clair County May 12. Seeking in excess of $100,000, Miles is represented by Michael P. Murphy and Carson C. Menges of Freeark, Harvey, Mendillo, Dennis, Wuller, Cain & Murphy of Belleville.

The complaint alleges the defendants are negligent for manufacturing and leasing a tractor/truck that was "unreasonably dangerous."

According to Miles, the truck did not contain a lap belt or seat belt and there were no warnings of the danger.

He was injured on Sept. 18, 2004. His injuries include acute vertigo.

Miles claims he will suffer for the remainder of his life.

He also claims he has expended large sums of money for medical and hospital care, has been prevented from attending to his usual affairs and duties and has lost great gains and earnings.

His employer, Southern Products, has been named as a respondent in discovery.
