AmerenIP filed a civil lawsuit against Envirocon Inc. claiming an underground gas line at the US Steel landfill in Granite City was damaged during excavation on Aug. 23, 2004.
Represented by Matthew Champlin of the Burroughs Firm in Edwardsville, AmerenIP claims Envirocon negligently and carelessly failed to keep excavating equipment and earthmoving equipment under control to avoid striking its underground facilities and negligently conducted excavating operations near underground facilities.
According to the suit filed May 9 in Madison County Circuit Court, AmerenIP claims Envirocon failed to supervise its employees, failed to maintain a proper lookout while operating excavating equipment, failed to train employees and failed to notify Ameren after the gas line was damaged.
The suit also claims that Envirocon violated provisions of the Illinois Underground Utility Facilities Damage Prevention Act by failing to plan the excavation, demolition or earth grading to avoid or minimize interference with Ameren's underground gas line and by failing to use white paint, flags, stakes or both to outline the dig site.
AmerenIP claims Envirocon struck and damaged the gas lines rendering them useless to customers.
Damages in excess of $57,290.55, plus costs of repair are being sought.
The case has been assigned to Circuit Judge Daniel Stack.
