Homeowner sued for failing to maintain his staircase

Joseph Clark is suing Belleville resident D.J. Burton for injuries sustained while climbing a staircase.

Clark claims he hurt his neck, shoulder and low back after the "poorly constructed" and "poorly lit" stairway at Burton's home at 124 Revere Drive gave way on March 18.

"That at all times relevant hereto, the plaintiff, Joseph Clark, was lawfully on the aforesaid premises as a commercial represenative exercising due care for his own safety," the complaint filed in St. Clair County Circuit Court April 26 states.

Clark, represented by Thomas C. Rich of Belleville, is seeking in excess of $50,000 in damages.

The complaint alleges Burton is negligent for failing to maintain his premises in a safe condition and keep the stairway properly lit.

Clark claims he has suffered disability as a result of his injuries, lost wages and experienced pain and suffering.
