Question: Could you please update the carpet tumble story at Sears in the Alton Square Mall? That story caught my attention last year and I have yet to see it reported on again. Thank you for your time.

Gonzo: Currently that case is still in the discovery stage. The case was filed on Jan. 20, 2005, by Sears employee Frances Loftus.
On June 1, 2005, the parties advised Circuit Judge Andy Matoesian that they were involved in meaningful settlement negotiations, however no settlement was reached.
Besides Sears, Loftus also named store manager, Julie Riviar, as a co-defendant.
According to the suit, for several months prior to Nov. 12, 2004, the date of the alleged accident, Riviar stated that the carpeting was going to be replaced, but because of budgetary issues, the project was delayed.
Loftus claims she tripped and fell to the ground with great force and violence, sustaining severe and permanent injuries to her knees, back, head, shoulders and back.
She claims she suffered great pain and mental anguish, spent great sums of money for medical and hospital treatment and expenses and will be unable to perform her usual activities.
Represented by Michael P. Glisson of Alton, Loftus also claims she has endured disability and loss of a normal life along with disfigurement and loss of wages. She is seeking damages in excess of $50,000.
The defendants' are represented by Stephen Maassen of Alton.
