A woman who sustained injuries to her ankle after slipping in dog urine filed suit against her friends for failing to clean their kitchen floor.
Wanda Vogler claims she was a guest at Jeremiah Boykin's Collinsville home on Nov. 2, 2005. Boykin allegedly noticed the dog urinated on the kitchen floor, but in his haste to get his daughter to school, failed to clean the mess the dog created.
According to Vogler, at about 9 a.m. she slipped and fell on the wet kitchen floor in the urine Boykin allowed to remain.
She claims Boykin had a duty to keep his house in a reasonably safe condition, but failed that duty by noticing the urine on the floor yet neglecting to clean it within a reasonable time.
According the complaint, Vogler sustained severe and permanent injuries to her right ankle resulting in multiple trauma requiring surgical intervention, hospitalization and rehabilitative convalescence.
Vogler also claims she has incurred medical expenses, experienced pain and suffering and has lost the quality of life she once enjoyed.
Represented by John Leskera of Collinsville, Vogler is seeking damages in excess of $50,000, plus all costs of the suit.
The case has been assigned to Circuit Judge Andy Matoesian.
