Collinsville couple sue landscaper for injuries

Shirley and John Warren of Collinsville filed a personal injury suit against Fetter's Landscaping claiming it failed to properly and safely construct a retaining wall on their property.

According to the complaint, Shirley Warren was walking on the retaining wall on Aug. 23, 2005, when a section of the wall gave way causing her to fall and break her right leg and ankle in three places.

The Warrens claim that Fetter's failed to properly secure the blocks making up the retaining wall, failed to properly utilize retaining wall cement to secure the blocks and failed to warn them of the dangers of stepping or standing on the retaining wall.

Shirley Warren claims her leg injury required multiple surgeries and hospital admissions and has caused and will continue to cause extreme pain and suffering. She also claims lost wages and loss of an ordinary life.

John Warren claims his wife's injuries have caused him to lose the society, care and companionship of his wife.

Represented by Joseph Hillebrand of Kassly, Cone, English & Hillebrand of Belleville, the Warrens are seeking damages in excess of $100,000, plus all costs of the suit.
