RP Lumber filed suit against Edwardsville-based Weber Homes claiming it refused to pay for building materials and supplies that were charged to their account.
According to the complaint filed in Madison County Circuit Court March 27, Weber Homes purchased $56,753.31 worth of merchandise from June 1, 2004 through Feb. 8, 2005, at the Edwardsville location.
RP claims that Weber Homes signed an application for credit on Aug. 12, 2002, which entitles RP to charge a 2% finance charge on all payments not made within 30 days of notice.
The complaint also states that pursuant to the credit application RP also is entitled to recover all reasonable costs and expenses of collection, including reasonable attorney's fees.
RP is represented by Ronald Lowery of Edwardsville.
The case has been assigned to Circuit Judge Don Weber.
