Gerald and Shannon Monroe filed suit against American Income Life Insurance Company of Waco, Texas and its agent Keith Dostie of Belleville in Madison County Circuit Court March 17.
Represented by Alton attorney Thomas Falb, The Monroes are seeking damages in excess of $50,000 claiming the insurance company breached its contract by failing to provide income, health insurance and a discount card for pharmacy and medical services.
The Monroes claim that on March 18, 2005, Dostie sold them life insurance, disability insurance and a supplemental health insurance policy and discount card for various pharmacy and health-related services.
They claim they accepted the offer and made and continue to make monthly payments of $30.34.
According to the complaint, American's conduct was intentionally done knowing that their agent was going to make material misrepresentations of the fact that the Monroes would rely on those misrepresentations.
They claim American's conduct is intentional fraud and that is violated the Illinois Consumer Fraud Act.
The Monroes are seeking compensatory damages, punitive damages, attorneys' fees, interest and costs for breach of contract, fraud and violations of the Illinois Consumer Fraud Act.
The case has been assigned to Circuit Judge Andy Matoesian.
