Alton & Southern named in FELA case

Dwight Baxton claims that he was grievously injured while attempting to throw a malfunctioning railroad switch in a Federal Employers' Liability Act (FELA) suit he filed in St. Clair County Circuit Court March 10.

Baxton is seeking damages in excess of $50,000 from Alton & Southern Railroad for the June 8, 2005 accident at the East St. Louis yard.

He claims Alton & Southern negligently and carelessly failed to provide him with a reasonably safe place to work and failed to properly maintain and otherwise monitor the function of their equipment.

Baxton claims he sustained permanent injuries and disability to his neck, back and legs which caused pain and suffering, past and future lost wages, and past and future medical expenses.

John Papa of Callis, Papa, Hale, Szewczyk & Danzinger represents Baxton.
