Son's attack at daycare prompts mother to sue

Jessica Skenderi claims her son's daycare provider failed to protect him from getting beaten up in the restroom. She filed suit against Eden Childcare in Glen Carbon in Madison County Circuit Court March 1.

Skenderi claims her son Brody was violently pushed and hit in the face while using the restroom on Dec. 28, 2005, causing him to sustained serious injuries to his face which had been previously operated on.

She claims Brody experienced pain and suffering and sustained a disability as a result of the attack.

Skenderi also accuses Eden Childcare of allowing the attacker to accompany Brody to the restroom unsupervised, even though workers knew, or should have known, of his alleged dangerous propensity.

Represented by John Hustava of Collinsville, Skenderi is seeking damages in excess of $100,000, plus all costs of the suit.

The case has been assigned to Circuit Judge Daniel Stack.
