Willow Creek named in wrongful death suit

Gerald Jones filed a wrongful death suit on behalf of the estate of Mildred Beasley in St. Clair County Circuit Court claiming Willow Creek Rehabilitation & Nursing Center failed to protect her from neglect.

According to Jones, Mildred sustained injuries including severe malnutrition, a urinary tract infection, urosepsis, deterioration of decubitus ulcers and multiple episodes of respiratory distress.

The complaint, which also names Quality Care Management and Robert Simpson, M.D., claims Willow Creek failed to notify Simpson of Mildred's deteriorating condition and failed to provide her with 24-hour nursing services.

Jones alleges that the nursing home failed to ensure that a nursing plan based on Mildred's problems and needs was established, which contained long term goals, short term objectives and approaches to meet her needs.

"Mildred Beasley suffered repeated pain and suffering and became further debilitated and disabled between Nov. 7, 2003, and the time of her death on Jan. 20, 2004," the complaint states.

Jones claims Simpson failed to order wound care consultation in a timely manner, failed to respond to Mildred's condition of malnutrition, failed to provide clear directions for "trach-trials," failed to provide instructions to wean her from the ventilator and failed to have her admitted to the hospital in a timely manner.

Represented by Staci Yandle and Donna Anderson of The Rex Carr Law Firm in East St. Louis, Jones is seeking damages in excess of $300,000 plus all costs of the suit.
