Man sues driver for damages following collision

A Monroe County resident is suing a St. Clair County man for allegedly causing a collision.

David L. Touchette of Columbia filed a complaint on May 5 in St. Clair County Circuit Court against James C. Esmon of Dupo, alleging breach of duty in a February 2014 accident.

According to the complaint, the plaintiff was traveling westbound on Lindemann Avenue in the Village of Dupo on or about Feb. 23, 2014. The defendant, driving southbound on Fourth Street at the time, collided with the passenger side of Touchette’s car, the suit states.

The complaint states that Esmon failed to sound a warning with his horn; maintain a sufficient lookout; apply his brakes or stop the car to avoid impact; and control his vehicle, allegedly breaching his duty to exercise due care and caution.

Touchette argues that he sustained serious personal injuries as a result of the defendant’s negligence. The plaintiff alleges pain, suffering, and mental anguish; lost wages and earning capacity; diminished everyday functioning, and medical expenses. He seeks damages in excess of $50,000, plus attorneys’ fees and costs.

The plaintiff is represented by Marc Scoggins of Crowder & Scoggins in Columbia, Ill.
