Maryville rehab facility sued over alleged slow response to stroke

The estate of a man who suffered a stroke is suing his nursing home for allegedly taking too long to provide him with medical care.

According to a lawsuit filed on May 6 in Madison County Circuit Court, Arlene Bertoglio, executor of the estate of Joseph Bertoglio, is suing UDI No. 2 LLC, doing business as Manor Court of Maryville.

Joseph Bertoglio allegedly suffered a stroke on March 6, 2014, while living at the defendant's nursing home. However, the plaintiff claims the defendant's employees, "although aware of the situation, failed and refused to obtain medical treatment" for the man.

The defendant and its charges are accused of failing to: notify Joseph Bertaglio's attending physician of his change in condition; provide immediate treatment to him; provide him with proper nursing care; supervise and oversee "a comprehensive assessment" of the patient; and neglected him in violation of law.

The plaintiff, alleging a deepening severity of his medical condition, pain and suffering, and greater medical expense for him and his family, seeks in excess of $50,000 in damages, plus costs.

The plaintiff is represented by attorney Robert H. Gregory in East Alton.
