Pedestrian sues driver in parking accident

A St. Clair County pedestrian filed suit against a man for allegedly striking him while attempting to back into a parking space.

Speed Allen Jr. filed a lawsuit on April 30 in St. Clair County Circuit Court against John Zimmerman, alleging vehicular negligence in a November 2014 accident.

According to complaint, Allen was walking in a southbound direction in the parking lot of City Hall in Fairview Heights on or about Nov. 19, 2014, when Zimmerman, operating a motor vehicle northbound in the same lot, struck the plaintiff while attempting to back his vehicle into a vacant parking space.

Arguing that the defendant was guilty of negligent acts or omissions and owed a duty to exercise reasonable care for the pedestrian’s safety, the suit alleges Zimmerman failed to maintain a proper lookout; changed the direction of his automobile unsafely and failed to stop, slow down, swerve or otherwise avoid an accident.

Alleging physical injuries, medical costs, loss of a normal life and permanent disability, Allen seeks damages in excess of $50,000, plus attorneys’ fees and costs.
