A St. Clair County man riding a motorcycle alleges he sustained serious injuries when another driver pulled his vehicle out in front of him, causing a collision.
Joseph Foutch filed a lawsuit on April 29 in St. Clair County Circuit Court against Lynn Duty of Dupo, claiming vehicular negligence in an April or May 2013 auto accident.
According to the complaint, Foutch was riding a motorcycle on either April 30 or May 30 in 2013 in East Carondelet when the defendant allegedly pulled out in front of his bike, causing a collision.
The suit accuses Duty of negligence in violating a traffic signal; driving at excessive speed; and failing to exercise care, keep a proper lookout, signal her intention to turn and yield the right-of-way. Additionally, the plaintiff alleges that the defendant was driving while using a cellular device.
Foutch alleges he sustained serious and permanent bodily injuries in his neck and back, causing pain and suffering, lost wages and medical care. The likelihood of continuing medical expenses creates further stress, the suit states.
Foutch seeks damages in excess of $50,000, plus attorney's fees and costs. He is represented by Patrick Hinrichs of The Bradley Law Firm, St. Louis.
