Homeowner accuses contractor of failing to finish remodeling project

A St. Clair County woman is suing a construction company and its employee for allegedly failing to complete the agreed upon remodeling work.

Bobbie Smith of O’Fallon filed a lawsuit on April 13 in St. Clair County Circuit Court against Gateway Construction Solutions Inc. and Andrew Kirchhoefer, alleging breach of contract and fraud in a home improvement project.

According to the complaint, Smith contracted with Gateway for exterior and interior remodeling of her home, 309 Aladar Drive in O’Fallon. She claims she paid for the work but the defendants either failed to perform the work, did so in a substandard fashion and/or refused to complete the project.

She accuses the defendants of failure to deliver fixtures for which Smith had already paid, such as cabinetry, failure to install siding and deliberate and willful disregard for the contractual agreement. The plaintiff alleges substantial damages.

Smith seeks compensation in excess of $75,000, plus punitive damages of $1 million, along with attorney fees and costs. She is represented by attorney Thomas Q. Keefe Jr. of Keefe & Keefe in Belleville.
