A Madison County man is suing another motorist, alleging negligence.
Frank Ratay filed a lawsuit on April 20 in Madison County Circuit Court against Taylor Rasheen, alleging negligence in a 2013 roadway accident.
According to the complaint, on May 30, 2013, Ratay was traveling northbound on state Highway 111 near the intersection of Chain of Rocks Road in Pontoon Beach. He was stopped at a traffic signal at an intersection when Rasheen allegedly fell asleep while driving and rear-ended Ratay’s vehicle.
The plaintiff accuses Rasheen of negligence, including failure to control his automobile, keep a proper lookout for other vehicles on the street, reduce speed, maintain a safe speed and stop in time to avoid collision with Ratay's vehicle.
The plaintiff alleges external and internal bodily injuries to his back, neck and other areas. The suit alleges physical pain, mental anguish, disability, loss of wages, loss of a normal life and medical expenses.
Ratay seeks damages in excess of $50,000, plus attorney fees and costs. He is represented by attorney Michael Glisson of Williamson, Webster, Falb & Glisson in Alton.
