Rothman Furniture says trailer owners liable for injury from fallen sofa

A Madison County furniture store is using two Illinois trailer owners after a sofa fell on an employee while he was trying to load the furniture into the trailer.

Rothmann Furniture Stores Inc. filed a lawsuit on April 20 in Madison County Circuit Court against Judy Kanallakan of Medora and Michael Kanallakan of Jerseyville, alleging negligence.

According to the complaint, on April 28, 2013, Brent Smith, an employee of Rothmann Furniture, was loading a sofa onto a trailer owned by Judy Kanallakan and in the control of Michael Kanallakan when Smith was injured as boards between the trailer and delivery truck broke, causing the sofa to fall on him.

Rothmman Furniture alleges the Kanallakans were negligent in failing to maintain the trailer in a safe manner or warn the employee of possible injury if he stepped on the boards.

The suit says Smith suffered serious and permanent bodily injuries, physical pain, mental anguish, emotional distress, loss of ability to enjoy life, lost wages and earning capacity and high medical expenses.

Rothmann Furniture Stores seeks damages in excess of $25,000, plus attorney fees and costs. The company is represented by attorney Jeffrey Benoisi of Law Offices of Stephen H. Larson in St. Louis.
