Deli meat manufacturer claims vendor has failed to full pay for 80K pounds of product

A manufacturer of cooked deli meats claims a Lakeland, Fla. food vendor has failed to fully pay for more than 80,000 pounds of product delivered last year.

Deli Star Corp. of Fayetteville filed suit against W.A. Kretch Co., doing business as Cafe Favorites, CEM Enterprises and Len Kretchman on Jan. 30 in St. Clair County Circuit Court.

The plaintiff claims that between May 8, 2014 and June 6, 2014, it shipped 45,774 pounds of turkey ham, 3,500 pounds of turkey bologna, 7,249 pounds of turkey salami, 22,000 pounds of turkey breast and 2,000 pounds of turkey pepperoni to the defendants for a total cost of $135,699.35.

"Defendants received and accepted said goods but have not paid agreed-upon consideration for them," the suit states.

Deli Star claims that Cafe Favorites agreed to pay $40,493 by June 13, 2014, and the remaining debt within 30 days in consideration of the plaintiff shipping another order and extending the company's credit limit above and beyond the previously agreed-to limit.

"Defendants never paid plaintiff as agreed, guaranteed and/or promised," the suit says.

Deli Star states that prior to June 18, 2014, Kretchman sold some or all of Cafe Favorites and ceased operations.

The plaintiff seeks in excess of $75,000 in damages, plus interest, costs and attorneys' fees.
