Case alleging attacker mistook plaintiff’s identity settled and dismissed

Madison County Circuit Judge William Mudge dismissed with prejudice a case alleging a man was injured during an altercation after being misidentified.

The parties filed a stipulation for dismissal after the suit was settled on Jan. 9.

According to plaintiff Dan Boyce’s Sept. 8 complaint, he was at 2505 State St., Alton, when “without provocation and knowledge as to what was about to happen,” he was injured by defendant Sherman LaMere. The lawsuit does not provide details about the chain of events but accuses LaMere of using “excessive force under the circumstances” and being “mistaken about the identity of the plaintiff.”

Boyce alleges injuries to his body that required him to seek medical care.

He accused LaMere of negligence.
