Trial set for case involving collision during test-drive crash

Madison County Circuit Judge Dennis Ruth has scheduled a jury trial for a case alleging a man’s vehicle was struck while the other driver was out on a test drive.

Aaron Vorpagel filed the Sept. 11 lawsuit against Ronald Huckfeldt Jr. and Todd Hemann.

According to the lawsuit, Hemann allowed Huckfeldt to take his car for a test drive on June 5. While Huckfeldt was driving west on I-70 in Pin Oak Township, a tire allegedly ruptured on the car causing Huckfeldt to hit the back of Vorpagel’s vehicle near milepost 70.

Vorpagel accuses Hemann of negligence for allegedly failing to properly maintain his vehicle. He also accuses Huckfelt of negligence and asks for more than $100,000 in damages for medical costs, lost wages and court fees.

The defendants answered the complaint on Oct. 30 denying the allegations against them.

On Jan. 28, Ruth set up a discovery schedule and ordered the parties to be ready for trial by November. A trial date for the case is set for Jan. 11, 2016.
