Employee alleges breach in workers’ compensation

A St. Clair County resident filed a lawsuit against a Madison County company, alleging unlawful termination.

William R.E. Dawson, of Fairview Heights, filed a lawsuit Feb. 9 in Madison County Circuit Court against Mike’s Inc. of South Roxana.

According to the complaint, Dawson, an employee of Mike's, was injured in an on-the-job accident Nov. 10, 2014, and applied for workers’ compensation. The defendant then terminated Dawson as a result, which does not comply with state employment law, the suit states.

The defendant suffered loss of income and benefits, mental anguish, and past and possible future pain, according to the suit.

Dawson seeks damages in excess of $50,000, plus attorney fees and costs. He is represented by attorney Jon E. Rosenstengel of Bonifield & Rosenstengel in Belleville.
