A Madison County couple are suing a driver for alleged recklessness in a February 2013 car accident.
Andrea N. Bodinet and David T. Bodinet of Highland filed suit against Nancy E. Scholl, also of Highland, in the Madison County Circuit Court Feb. 12 on allegations of vehicular negligence.
According to the filing, Scholl went through a stop sign while driving northbound on Sunflower in Highland and collided with Andrea Bodinet’s car. The plaintiffs claim Scholl breached her duty as a driver by not maintaining a lookout for oncoming vehicles; by not reducing her speed near an intersection or yielding the right of way; and failing to brake to avoid the accident.
Injuries sustained by the plaintiff allegedly include illness, soreness, pain and suffering.
Bodinet claims to have expended large sums of money on medical care and seeks over $50,000 in compensation for purported disability, loss of functionality in everyday life, and loss of earning capacity.
According to the complaint, David Bodinet alleges loss of companionship, support and services from his wife as a result of the accident and also seeks damages in excess of $50,000, plus court costs.
The plaintiffs are represented in the case by Jeffrey Ezra of Ezra & Associates, Collinsville.
