Lumberyard Suppliers alleges it is still waiting for more than $100,000 after it supplied materials to a construction company.
Lumberyard Suppliers of Madison County filed a lawsuit Feb. 6 in Madison County Circuit Court against Patrick Horton doing business as H&M Construction.
According to the complaint, Lumberyard delivered certain materials to H&M between 2010 and 2014, and H&M has refused to pay for the goods.
"After all applicable credits, defendant remains liable to plaintiff for said goods, plus late charges, in the sum of $112,552.97," the suit states.
In addition to the money it alleges it is owed, Lumberyard seeks interest, costs and attorney fees. Attorney Mark M. Silvermintz, of The Kunin Law Offices in Collinsville, will represent the plaintiff.
